While trying to get the lowdown on Fair Use laws, I came across this old gem from the Hoosier Hot Shots. As is typical of the music videos genre, there’s a fair amount of debauchery in this epic of Otto Zilch. So consider yourself warned.

    Fair Use? A doctrine with many undefined areas, since the relevant statute, Section 107 of the 1976 Copyright Act, is inherently vague.

    But I seem to remember reading the gloss of one scholar, to the effect that ‘It’s better to apologize than to ask permission.’

    (I don’t think he’s a legal scholar, though….)

    Are you thinking of song lyrics? There is no fair use with song lyrics. I paid $300 to use three lines from Tom Waits, and that was after writing a pleading letter explaining that I was a poor Catholic author. Book Two had a gloss on Peter Gabriel’s “Love to be Loved,” and the first editorial note I got back after turning in the ms. was “Start thinking about how to rewrite the Peter Gabriel section. There is no way you could afford to print all those lyrics.” I mean, sure, we do it on blogs all the time, but once they’ve got someone they can sue (What Is The Kollektiv?)…

    You write well and about things that are relevant to my interests.

    Would you have liked to gain recognition for your talents when you were younger? It’s never too late, and it’s certainly worth having a dream to keep yourself going on dark winter days when you feel no-one loves you, but I don’t think these attention attracting posts are necessarily the way to proceed. Hope that helps.
